Booking Agreement
Terms & Conditions

By payment of deposit you certify that you are fully aware this is a contract between yourself and Chandler Tours, Inc. and you agree of your own free will to all of the terms and conditions of this contract 

AGREEMENT TO BE BOUND: By booking your travel arrangements with Chandler Tours, Inc., you are agreeing to be bound by the terms and conditions together with any additional documentation we give you (“The Agreement”). The Agreement describes what you are legally entitled to expect when you book your trip. The lead guest assumes the responsibility of sharing these Terms and Conditions with each guest for whom they make a booking. Chandler Tours, Inc. is not responsible for any guest’s unawareness of the Terms and Conditions due to the failure of the lead guest to share this information with all other guests in their party.

 

RESERVATIONS, DEPOSITS & FINAL PAYMENT: Many costs are incurred before departure, therefore reservations will be secured upon payment of a deposit. No reservation is considered firm until deposit has been received by Chandler Tours. Your initial deposit payment shall be deemed to be an acceptance of this Booking Agreement and Terms and Conditions for yourself and all members of your party. Any failure to make timely payments may result in cancellation of your tour at the sole discretion of Chandler Tours. In such case our cancellation policy would apply.

The price of the tour includes a built-in discount for cash or check payments. There is a limited discount or no discount on digital and credit card sales. 

You hereby agree to refund policies and procedures as outlined in these Terms and Conditions. In the event a guest attempts to chargeback, reverse, or recollect a trip payment already made without the authorization of Chandler Tours, we reserve the right to collect all additional costs and expenses associated with such chargeback, reversal or recollection without limitation, including attorney fees.

 

TRAVEL DOCUMENTS: A U.S.A. passport valid for 6 months after the return date of the trip is required for travel to some countries. It is the sole responsibility of the guest to check their passport’s expiration date, and to ensure they have all required travel documents for the tour and for re-entry into the U.S.A. Some countries also require purchase of an entry visa. Chandler Tours assumes no liability for lack of proper documents. Chandler Tours is not liable for denied entry or denied boarding, and no refund will be available in any such cases.

 

CHILDREN: Acceptance of children on the tour is at the sole discretion of Chandler Tours and we reserve the right to accept or reject children’s participation on the tour at any time and for any reason. Accompanying adults are responsible for the behavior and safety of the children.

 

AIR TRANSPORTATION:  Flights and air routings are at the discretion of air carriers and are subject to change. Cancellations made after air tickets have been issued are subject to full cancellation penalties as imposed by the airlines. Guests are responsible to bear any name-change fees should they not provide Chandler Tours with accurate passport information.

Airfare purchased by Chandler Tours is subject to each airline’s passage contract and terms and conditions. Once air tickets are issued, said passage contract shall constitute the sole contract between the airlines and the guest. Airfare rules will apply to tours cancelled for any reason. Schedules, routings, connections, and connection times are at the sole discretion of the airline and Chandler Tours has no control over this. Chandler Tours has no control over government security measures or their impact on airport connection times. Travel may require the use of Personal Protective Equipment, COVID-19 testing, and health documentation/inoculation/vaccination records. It is the sole responsibility of the guest to understand and adhere to all of these requirements. Chandler Tours has no liability or responsibility for the failure of the guest to comply with government and airline requirements.

 

TAXES/AIRLINE SURCHARGES: U.S. departure taxes, overseas airport taxes, overseas local government taxes, airline security fees and airline imposed international surcharges are included in your tour price and are based on the given rate when the tour is priced. Future price increases may be applied due to changes imposed by a supplier or governments.

 

SURCHARGE: DOLLAR FLUCUATION

In Israel, local prices are based on the New Israeli Shekel (NIS). Tourism service providers have notified tour operators that any additional costs resulting from currency fluctuations that lower the Bank of Israel exchange rate lower than NIS 3.4 = USD $1 shekels (at time of arrival) will be borne by tour participants.

 

MEALS:  Dietary requests should be provided at the time of booking. It is the sole responsibility of the passenger to ensure that all food and beverage contents provided to them meet their dietary needs. Chandler Tours has no liability or responsibility for food and beverage contents that do not meet the guest’s requests.

 

SIGHTSEEING: As a courtesy to others in the tour, it is mandatory that you be on time for all scheduled experiences. Failure to arrive will be considered a no-show for which no refunds will be available. Tour times are set to accommodate climate, crowd size and best viewing options for our group. It will be the sole responsibility of the guest to bear any necessary expenses to rejoin the group. 

 

OPTIONALS/ALTERNATE ACTIVITIES: Any suggestions for activities in place of a planned stop or in case of leisure time do not constitute Chandler Tours’ endorsement. In such a case you will be subject to the terms and conditions of the supplier of the activity and your only recourse in case of damage or loss will be against said supplier.

 

SERVICE CHARGES/TAXES/PORTERAGE: Service charges and taxes normally included in bills, government taxes on hotel bills (excluding hotel tourist taxes), taxes on sightseeing and excursions trips and porterage at hotels of one normal size suitcase, where available, are included in the tour price based on the given rate of a specific date. Porterage may not be available at select locations or airports.

 

LAND ONLY ARRANGEMENTS: All land-only requests must be received by Chandler Tours in writing no later than 110 days prior to departure. Land-only arrangements (tour package excluding air transportation) are provided as a courtesy at the sole discretion of Chandler Tours. By purchasing a land-only package, you are responsible for your own air arrangements and for transfers between airports and hotels. 

 

BAGGAGE: It is the guest’s responsibility to check airline baggage policies prior to departure. Chandler Tours is not responsible for baggage fees imposed by air carriers. Due to space limitations, only one piece of luggage per guest is allowed on motorcoaches, plus a carry-on bag with dimensions of 12”x11”x6” inches maximum which must fit in the overhead bin or underneath the seat in front of you. Wheeled carry-on bags are not permitted in the motor coach seating area since they will not fit into the overhead compartments. Security of your baggage is your responsibility throughout the trip. Chandler Tours is not responsible for loss, theft, or damage to baggage and/or personal belongings at any time during the tour.

 

TRAVELERS REQUIRING SPECIAL ASSISTANCE: Disabled guests requiring special attention or care must advise Chandler Tours in writing at the time of reservation. A physically able companion must accompany any person who needs special assistance. Tour-related personnel are not able to provide such assistance. Chandler Tours is not responsible for any denial of services to the disabled guest by air carriers, hotels, restaurants or other independent suppliers. Chandler Tours is not responsible for any guest requiring special medical equipment. Chandler Tours reserves the right to remove any individual from a tour if notification was not provided and/or when, in our sole judgment, continued participation would significantly hinder the services to be provided to all guests. Expenses, including cancellation fees and/or costs for alternate travel plans or to return home, will be the responsibility of the passenger. 

Certain activities or venues may be limited or inaccessible to you if your mobility is limited. You are responsible for assessing if the itinerary is suitable for all guests on your reservation. No refunds are provided for missed services or activities due to not fully participating with the group.

 

GUEST CANCELLATIONS: Tour cancellations must be received by Chandler Tours in writing. Cancellation policy is based on the number of days prior to departure by which the notification is received and will be effective on the date of receipt. Cancellations received on weekends or holidays will be considered received on the next business day. See the below terms for cancellation charges.

Cancellation of the May 5-15, 2025 tour to England, for any reason, will result in nonrefundable penalties as follows:

​

  • 100 or more days before departure: $100 of original deposit

  • 99 to 70 days before departure: $1,200 per person

  • 69 to 35 days before departure: 50% of tour price

  • Less than 35 days before deparature: Full price of tour

 

Cancellation of the 2025 Egypt & Niule Cruise tour for any reason will result in nonrefundable penalties as follows:

  • More than 100 days prior to departure: $100 of original deposit

  • 100 to 51 days prior to departure: $1,200 per person

  • 50 to 31 days prior to departure: 50% of tour price

  • 30 or fewer days to departure: Full price of tour

​

Cancellation of tours to Israel for any reason will result in nonrefundable penalties as follows:

​

  • More than 100 days prior to departure: $100 of original deposit

  • 100 to 61 days prior to departure: $2,000 per person

  • 60 to 51 days prior to departure: 50% of tour price

  • 50 days or less to departure: Full price of tour

​

Cancellation of tours in partnership with Nawas International Travel will follow the policies spelled out in the Nawas brochures.

​

Travel insurance is strongly recommended to protect your trip investment.

​

Chandler Tours reserves the right to cancel your reservation and retain your deposit if final payment is not received by the due date. Airline tickets are not refundable once issued. No refunds will be given for any unused services while on tour. No Shows are subject to a 100% cancellation fee and their reservation will be cancelled.

Land costs are based on rates, tariffs, overseas government taxes, and rates of exchange in effect on a specific date. Any increases in land costs or airfare that may occur will be collected from each guest prior to departure. We reserve the right to increase the cost of the tour consistent with normal increases in the event of fluctuations in exchange rates. While every effort will be made to hold them firm, prices are subject to change. You understand and acknowledge that the tour you are purchasing is subject to supplemental price increases that may be imposed after the date of purchase. You hereby consent to any post-purchase price increases and authorize Chandler Tours to charge you for such additional amounts.

 

NON-OPERATION OF GROUP TOURS: If a tour turns out to not have sufficient participants to economically operate, cancellation of the tour may occur at the sole discretion of Chandler Tours. In any such case, guests will be advised at least 45 days prior to departure. Chandler Tours reserves the right to change the departure date. You may choose to accept these arrangements and Chandler Tours will refund the difference in price if the alternate is lower. If this rebooking option is not acceptable to you or in the case where alternatives are not offered, the only responsibility of Chandler Tours is to refund the amounts paid by you for the reservation, except in the case of Force Majeure as described herein. Any air cancellation will be in accordance with the terms of the carrier and Chandler Tours will not be liable should the carrier refuse to make a refund. In such case Chandler Tours will not be liable for any additional costs incurred outside of the tour package including passport fees, travel insurance, or any other purchases made by the guest in anticipation of the tour.

 

CANCELLATION BY CHANDLER TOURS: We reserve the right to cancel or reschedule any departure, reservation, or travel arrangement for any reason, including your violation of any of these Terms and Conditions. If we cancel, except in the case of Force Majeure or Non-Operation of Group Tours, as described herein, we may offer alternate arrangements, but there is no guarantee of availability. We may at our sole discretion offer travel credit or refunds in accordance with the applicable Guest Cancellations schedule. Guest is responsible for any additional costs for air tickets or other travel arrangements not made by Chandler Tours. Guests cancelled for violation of any terms will not be entitled to any refund, credit, or future travel.

 

FORCE MAJEURE: Chandler Tours assumes no liability for, any loss, damage, delay, or cancellation resulting from a so-called Act of God or any other force majeure condition, including, without limitation: fire, volcanic eruption, environmental pollution or contamination, inclement weather, earthquake, low or high water levels, flood, water or power shortages or failures, tropical storms or hurricanes, riots or civil commissions or disturbances, and any other acts of a similar nature, sabotage, arrests, strikes or labor disruptions, restraint of rulers or peoples, expropriations, acts of terrorism, criminal activities, war, insurrection, nuclear events, event cancellations, event postponements, supplier bankruptcy or insolvency, default of a supplier in providing the agreed upon transportation or service, quarantine restrictions, government health advisories, epidemics, pandemics, or warnings or alerts of any kind of nature, government seizures, refusal or cancellation or suspension or delay of any government authority or any license, permit or authorization, damages to its facilities or the travel supplier and its facilities, or any other unforeseen circumstances or factors that impact negatively on, or hampers, its ability to fulfill any of its contractual conditions. In the event any of these conditions apply, Chandler Tours shall be excused, discharged, and released from performance to the extent such performance is so limited or prevented, without liability of any kind including liability to make any refund. In the case of a force majeure event, Chandler Tours’ sole obligation will be to provide travel credits in the amount already paid, and only to the extent Chandler Tours’ suppliers credit us with monies paid to them. The travel credit is applicable to a future Chandler Tours trip. In no case will Chandler Tours be liable or responsible for a supplier’s bankruptcy, default or insolvency and in such case Chandler Tours will not be required to honor supplier credits. In any such case, you agree that Chandler Tours’ efforts with suppliers are made in good faith and in no case will Chandler Tours be required to proceed legally against any supplier.

 

TRAVEL PROTECTION PLAN: Chandler Tours strongly encourages all guests to purchase a Travel Protection Plan which at a minimum should cover Trip Cancellation or Interruption, Medical Expense, Emergency Evacuation/Repatriation, and Baggage. Purchasing coverage may be limited by time constraints so it is imperative you purchase protection as soon as possible after booking. Chandler Tours is not equipped to answer technical questions about travel insurance policies. If you have questions about your travel protection, call your insurer or insurance agent or broker.

You acknowledge that declining travel protection plan coverage could result in the loss of your travel cost and/or require more money to correct the situation. If you choose to travel without adequate coverage, we will not be liable for any losses howsoever arising, for which trip protection plan coverage would otherwise have been available. 

 

GENERAL DISCLAIMER/RESPONSIBILITY

​

RELEASE FROM LIABILITY: Chandler Tours, Inc. and its employees, agents, shareholders, directors, officers, successors, and assigns [including Florida College and the Florida College Hutchinson Bell for the October, 2024 tour],  (collectively “The Released Parties”) may offer promotional services, purchase transportation, hotel and other lodging accommodations, meals, restaurants, ground handling, tour director and guide services, and other services from various independent suppliers. All such persons and entities are independent contractors. The Released Parties are not liable for any negligent or willful act or failure to act of any such person or entity, or of any third party. The Released Parties act only in the capacity of agents in all matters pertaining to tour promotion, air transportation, hotel accommodations, sightseeing tours and transportation by any means.  Guest shall indemnify and hold harmless Chandler Tours, Inc., and The Released Parties from all suits, actions, losses, damages, claims or liability for any personal injury, death, property damage or other loss, accident, delay, inconvenience or irregularity which is occasioned by any negligent acts or omissions of The Released Parties arising out of any goods or services provided for this trip.

The Released Parties assume no liability or responsibility for any injuries, inconveniences, illness, irregularity or incidental damages occasioned by or resulting from, but not limited to, so-called Acts of God, acts of government, Force Majeure, circumstances beyond the control of The Released Parties, strikes or other labor activities, revolts, riots, political upheaval, wars, political rhetoric made by anyone that may have a real effect or psychological effect on the perception of a destination that you may be visiting, criminal or terrorist activity or the threat thereof, nuclear events, environmental pollution or contamination, water or power shortages, diseases, diseases and dangers associated with or bites from animals, pests, or insects, marine life or vegetation of any sort, or through human contact/interaction, pandemics, epidemics or the threat thereof, natural disasters, weather, wet conditions, closures of airports, closures of hotels, closures of included sites, overbooking or downgrading of accommodations, denial of boarding, event cancellations, event postponements, supplier bankruptcy, default or insolvency, default of a supplier in providing the agreed upon transportation or service, structural or other defective conditions in hotels or other lodging facilities, mechanical or other failure of airplanes or other means of transportation or for any failure of any transportation mechanism to arrive or depart timely or safely, dangers incident to recreational activities such as swimming, walking, sailing, boating, riding of any animal, or bicycling amongst others, sanitation problems, food poisoning, lack of access to or quality of medical care, difficulty in evacuation in case of a medical or other emergency, default or omission of any common or private carrier, or any other cause beyond the direct control of the Released Parties. In addition, you, your estate and heirs, legal representatives and assigns release the Released Parties from their own negligence and assume all risk thereof.

 

ADDITIONAL RISKS: Additional risks and dangers may arise including, but not limited to, hazards of travel by any kind of vehicle, aircraft, water vessel, or any other means of conveyance, animal interactions, human interactions, forces of nature, political unrest, other unrest, risks associated with water, food, plants, insects and differing animal regulation, and acts of national and local governments and unrest and acts of others against governments, event cancellations, event postponements, and supplier bankruptcy, default or insolvency. These risks are not an exhaustive list but are examples of many kinds of risks. You are voluntarily participating in these activities and hereby agree to accept any and all risks.

You understand the physical requirements of the activity in which you will be participating, and you currently have no known physical, medical or mental condition which would impair your ability to participate in this tour or your safety in this activity, and you are willing to assume all risks that may be created, directly or indirectly, by any such condition. As lawful consideration for the agreement with Chandler Tours and the hosts and organizers to participate in such trips and activities you agree you will not make a claim against Chandler Tours or its personnel nor the tour leaders, hosts and organizers or sue for bodily injury, emotional trauma, death, property loss or damage or other loss, cost or expense, however caused, as a result of or related to your contracting for, traveling to or from, or in any and every other way participating in the trip. You release Chandler Tours and its personnel, hosts and organizers from any and all claims, known or unknown, arising from contracting for, traveling to or from, and in any and every way participating in a trip. This release of liability and assumption of risk agreement is entered into on behalf of you and all members of your family and party, also including minors. This agreement also binds your Estate and heirs, legal representatives and assigns and this provision shall be enforceable even after your trip has ended.

Chandler Tours is not responsible and will not be bound by promises (written or verbal) made by local hotel staff or any other persons not under direct employment of Chandler Tours.

 

CHANGES TO THE TOUR: Without limitation, Chandler Tours reserves the right to cancel, advance, postpone or modify the tour that you have booked, including, departure or return dates, as well as locations, events and schedules, and may, but is not obligated to substitute, vary, alter, reschedule, cancel and/or relocate any accommodations, modes of transportation and other aspects of the tour. Additionally, Chandler Tours reserves the right to make changes to the tour, including deleting, adding, or substituting overnight locations and/or visited locations, substituting Tour Leaders or operating the tour without a Tour Leader, duration of itinerary, itinerary sequence, included sites, accommodations, including upgrading or downgrading of accommodation quality, event inclusions, meals, transportation modes, tour guides and included guide services. Chandler Tours is authorized to take these actions due to causes or circumstances of any kind or nature beyond the control of Chandler Tours, or causes or circumstances within the control of Chandler Tours that Chandler Tours deems to make such actions appropriate. Chandler Tours will not be liable for cancellation, delay, rescheduling or other adjustment or impact to a departure or itinerary, or other aspects of the tour.

 

CHANGES TO THE TERMS AND CONDITIONS: You acknowledge and agree that Chandler Tours may change these Terms and Conditions from time to time and that those changes become effective immediately. If we make material changes, we will provide you notice. Your continued use of our services following the notice of any material changes constitutes your acceptance and agreement to be bound by such changes. You agree to be bound by the Terms and Conditions that are in effect at the time of travel or cancellation.

 

COVID 19 RELEASE OF LIABILITY: Guest expressly acknowledges that naturally occurring diseases and viruses (including, but not limited to, COVID-19) may be present in all environments in which your tour will take place. You acknowledge the novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization. You also understand that if you are older or have underlying conditions, you may be more prone to serious infection and death due to COVID-19. By booking a trip, you acknowledge that exposure to such viruses or disease is an inherent risk of traveling and voluntarily assume the risk for yourself.

You acknowledge that due to the uncertainty of travel at this time, your trip may be postponed or cancelled, or changes may be made to itineraries due to closures of certain sites or activities, for which there may be no refund. You may also be required to quarantine upon arrival in some locations. You understand that you may become sick before, during, or after the trip and may not be able to travel and such cancellation or interruption will be subject to our cancellation terms below, for which we will not be liable.

You, for yourself and on behalf of your and their heirs, assigns, personal representatives and next of kin, hereby release, indemnify, and hold harmless Chandler Tours, Inc. and its members. officers, agents, and/or employees, suppliers, and other tour members (RELEASEES), of from and against any and all claims, damages, demands, losses, and liability arising out of or related in any way, in whole or in part to any postponement, cancellation, changes, injury, disability, death or any other loss you may suffer due to exposure, infection, spread, closure, and travel restrictions related to COVID- 19, to the fullest extent permitted by law. The terms of this Indemnification, Hold Harmless and Release of All Liability paragraph, shall survive any termination or cancellation of this Contract, whether by operation of law or otherwise.

 

HEALTH: For the safety of our guests, Chandler Tours reserves the right to request health information prior to travel and to exclude any participants it deems unfit for travel at its sole discretion. 

It is your sole responsibility to secure in a timely manner and/or pay for any and all immunizations, vaccinations, tests, screenings, and health standards that are required to be permitted to fly and for entry into each country or destination. Certain countries may have a requirement for foreign visitors to have valid medical insurance and proof of immunization and vaccination on entry. Additionally, Governments may require guests to submit to tracking for health purposes. Chandler Tours is not responsible or liable in the event that governments impose procedures or restrictions and you fail to comply with these and it is your responsibility to be aware of and comply with the requirements of the destination that you will be traveling to. Failure to submit to governmental requirements with regard to health and safety may result in the guest being denied entry. In such case Chandler Tours will have no responsibility whatever and will make no refund.

Required inoculations/vaccinations, screenings, or tests, if any, must be recorded by client’s health practitioner on a valid vaccination/screening/test certificate which the client must carry for proof of inoculation/vaccination/screening/test where required. Any person who arrives to the destination ill with apparent fever or becomes ill during the tour may be required to be removed from the group and directed to a local medical facility for diagnosis. Only upon written clearance from an accredited medical facility that the guest is able to continue participating in the remaining activities of the tour will that guest be allowed to resume group travel. All costs associated with medical treatment and related expenses such as additional hotel nights, the purchase of new airline tickets, or transportation not included in the original itinerary will be the responsibility of the guest.

In the event that proof of a vaccination (of any type) or health screenings or testing of any nature is required to travel by airlines, public or private transportation, cruise vessels, hotels, restaurants or touring sites, by governmental entities or any tour related entity, it is understood that it is the sole responsibility of the guest to facilitate the acquisition of the vaccination(s), screenings, or tests and to carry proof of vaccination, screening or test. Costs for vaccination(s), screening or tests or other related logistics are totally at the expense and responsibility of the guest. If, after a guest has made payments for a tour but subsequently elects not to receive a vaccination(s), screening or tests, or for any reason is unable to receive a vaccination or screening or test in a time-frame that allows them to travel on the scheduled departure dates, regardless of the reason, or if the guest tests positively or is required to quarantine, the terms and conditions including the cancellation policies apply and are not altered.

 

YOUR CONDUCT AND INDEMNIFICATION: Each guest is expected to act responsibly and adhere to all behavior guidelines established by Chandler Tours and our local suppliers. We and our local suppliers reserve the right to remove you, with no refund, from any trip if you endanger yourself or others or disrupt the general well-being of the trip itself.

When you book with us, you accept responsibility for any damage or loss caused by you. Full payment for any such damage or loss (reasonably estimated if not precisely known) must be paid direct at the time to the accommodation owner or manager or other supplier. You must indemnify us for the full amount of any claim (also including legal costs) made against us. Chandler Tours is not responsible for any costs incurred concerning a guest removed from a tour. Baggage and personal effects are at all times the sole responsibility of the guest.

 

SCHOLARSHIP PAYMENTS: For any tour that includes financial offerings for scholarships, all funds intended or designated for such purpose will be collected by Chandler Tours, Inc. as part of the tour package and are subject to the Terms and Conditions for the tour package. All funds designated for scholarships will be applied only after all payments required for operation of the tour, including payments to airlines, hotels, and other third parties providing travel-related services for the tour, have been completed. When the specified tour has completed operation, Chandler Tours, Inc. will send all scholarship monies to the fund or organization previously designated in the official tour description and promotional materials. To ensure all scholarship monies specified as part of the tour package are sent to the designated fund or organization in a timely manner, said funds will be collected within the designated timetable for tour payments, as part of the tour package, and shall not be paid separately by tour participants.

RIGHT TO ACCEPT OR REJECT: Chandler Tours reserves the right to accept or reject any person as a guest prior to departure for any reason or no reason at all. In the event of rejection of participation prior to departure, the only responsibility of Chandler Tours is to provide you with a full refund of all monies paid for the reservation, excluding any non-recoverable costs.

 

ENGLISH LANGUAGE: In the event this Agreement is translated into any other language or script, only this English version shall control.

 

SEVERABILITY: If any provision of these terms and conditions shall be held unenforceable, such provision shall be struck and the remainder shall remain enforceable.

Jurisdiction/choice of law/venue: exclusive jurisdiction and venue for any and all disputes arising under, in connection with, or related to these terms and conditions or the provision of services by Chandler Tours, Inc. shall be in the state court sitting in Hillsborough County, Florida, and you expressly agree not to challenge the jurisdiction or venue of such court or to assert that such court is not a convenient forum. All disputes arising under, in connection with, or related to these terms and conditions or the provision of services by Chandler Tours, Inc. shall be governed by the internal laws of the state of Florida, without regard to its conflicts of law provisions. 

You agree that class action lawsuits, class-wide arbitrations, and any other proceeding where someone acts in a representative capacity are hereby waived and disallowed to be brought against Chandler Tours, Inc. Your payment of a deposit on a tour means that you agree to these conditions of sale for yourself and all members or your party or group and expressly waive any right to punitive damages.

 

ATTORNEY’S FEES AND COSTS: If either party brings an Action to enforce their rights under this agreement, the prevailing party may recover its expenses (including reasonable attorneys’ fees) incurred in connection with the Action and any appeal from the losing party.

 

KNOWING AND VOLUNTARY AGREEMENT: You certify that you are at least 18 years of age and that you have complete understanding of these terms and conditions and your tour’s brochure and reservation form. By payment of deposit you certify that you are fully aware that this is contract and a release of liability between yourself and Chandler Tours, Inc. and you agree of your own free will to all of the terms and conditions of this contract and release from liability.
